Benjamin Herbst

Benjamin Herbst is the founder and managing partner of The Herbst Firm and specializes in criminal defense in all South Florida jurisdictions. Mr. Herbst has extensive trial experience, with over 70 jury trials and hundreds of pre-trial motions to his credit. He has achieved acquittals in dozens of jury trials ranging in severity from misdemeanor traffic offenses to life felonies.

He received his undergraduate education at the University of Michigan, Ann Arbor, graduating with university honors with a B.A. in political science. Mr. Herbst went on to receive his J.D. from the University of Miami, Coral Gables. While in law school Mr. Herbst first learned the practice of criminal defense working for the Miami-Dade Public Defender as a certified intern. He also worked for a medium sized personal injury law firm in Coral Gables during his law school years.

After graduating from law school from the University of Miami Mr. Herbst went on to serve as an assistant public defender in Broward County where he represented close to 1,000 different clients in cases ranging from misdemeanors such as DUI and possession of marijuana, to life felonies such as armed robbery and carjacking. Mr. Herbst then left the public defender’s office to work for the trial firm of Dell & Schaeffer in Hollywood, a multi practice law firm specializing in criminal defense and personal injury in the South Florida area.

He has successfully represented defendants in felony and misdemeanor cases in Miami-Dade, Broward, Palm Beach, Martin and St. Lucie Counties, and has worked for both the Miami and Broward Public Defenders prior to gaining enough experience to run a private law firm. Benjamin is completely dedicated to his criminal defense clients and all clients are provided with his cell phone number for weekend and off hour access. He is also willing to discuss the cases with family members and even friends as long as the client wishes for that to happen. Benjamin has extensive federal criminal defense experience and has represented clients in front of United States Magistrate Judges and appointed United States District Court Judges.

In addition to representing adult clients in County and Circuit Court, Benjamin is also an experienced juvenile criminal attorney who has helped numerous teenage clients keep their records clean and remain with their families when facing the most serious felony charges.
